Terms of use
This translation is for information only. Only the German version of these terms is legally binding.
1. Who we are and what these terms cover
wgzimmer.ch is operated by esense GmbH, Burgweg 7, 4058 Basel, Switzerland (UID CHE-109.890.884), e-mail info@wgzimmer.ch (“wgzimmer.ch”, “we”).
These terms apply to everyone who uses wgzimmer.ch or the wgzimmer.ch app: anyone who views ads, posts an ad, has an account or writes to an ad. By posting an ad, logging in and sending a message you accept the version published at that time.
2. What wgzimmer.ch offers
- wgzimmer.ch is a platform for ads of free rooms in flatshares (offers) and of people looking for a room or flatmates (searches).
- We are not a party to the leases or subleases concluded through wgzimmer.ch and do not act as a broker. Only the people involved are responsible for contracts, rents and deposits.
- We check ads for obvious violations before publishing them, but cannot guarantee that their information is correct. How to protect yourself from fraud: see the flatshare tips.
- wgzimmer.ch is free for private persons; only optional extras are paid (section 6).
- We aim for good availability but cannot guarantee it. Interruptions for maintenance, outages and changes to the service are possible.
3. Account
- You log in with your e-mail address and a code we send you by e-mail. There is no password. The account is created with the first code.
- Protect access to your e-mail address: anyone who has the code can use your account.
- You can delete your account at any time under “My account”. This also deletes your ads.
- We delete accounts that have not been used for 5 years.
4. Ads
Who may post ads
Private persons and flatshares post for free. Commercial providers, for example real estate companies or landlords of furnished flats, post only with a written agreement with us.
What an ad must contain
- An ad describes a real, available room in a flatshare or a real search, truthfully and completely.
- If you sublet a room, you need the landlord’s consent.
- Photos are your own or you hold the rights to them. You only show people with their consent.
What is forbidden
- discrimination, racism, sexism, hostility and offensive content
- fraud and misleading information
- advertising of any kind, in particular for other housing providers or services
- several ads for the same room
- content that infringes the rights of others or the law
Review, duration and deletion
- Every ad is reviewed before it is published. After changes to the texts or contact details we review it again; it stays online meanwhile.
- An ad runs for 42 days from posting or the last renewal. We remind you by e-mail 7 and 2 days before; you can then renew it.
- After that it goes to the archive. From there you can reactivate it; it is then reviewed again.
- You can delete your ad at any time with the code or in your account. It also goes to the archive.
- We delete archived ads for good 2 years after their end, together with their photos and messages.
5. Messages to ads
- You must be logged in to write to an ad. The message is sent by e-mail to the person who posted the ad; your e-mail address is included as the reply address so they can answer you directly. We store the message.
- Messages are only for enquiries about the ad. Advertising, mass messages, fraud attempts and harassing content are forbidden.
- To prevent abuse we limit the number of messages, remove links (except to LinkedIn and Instagram) and e-mail addresses from the text and may hold back messages.
6. Paid extras
- For an ad you can book optional paid extras, for example more photos, no advertising on the ad page, regular moving up in the list or highlighting. Before you pay we show you which extras there are, what they cost and how long they last. Prices are in Swiss francs including VAT.
- Payment is made through our payment providers (Stripe, PostFinance Checkout, in the app through the App Store or Google Play). Their terms apply as well.
- The extras apply to the ad you paid for, also after a renewal or reactivation.
- If we delete your ad or do not publish it without you having breached these terms, we refund the amount paid. If we delete it because of a breach or a well-founded suspicion of fraud, or if you delete it yourself, there is no refund.
- Minors need the consent of their legal representative for paid extras.
7. Moderation and blocking
- We may refuse, take offline or delete ads and messages and block accounts or e-mail addresses if they breach these terms or the law or if there is a well-founded suspicion of fraud. We tell you the reason unless this would endanger others or hinder an investigation.
- We keep blocked ads to recognise further fraud attempts and may show them as a warning on the page “Blocked ads”.
- We report the e-mail address of an ad we block for fraud to the service Checkscammail, which warns against fraudulent addresses.
- You can report suspicious ads and messages to abuse@wgzimmer.ch.
8. Rights to content
- The texts and photos of your ad remain yours. You allow us, free of charge and for the duration of the ad and the archive, to store them, to process them (for example the size of photos) and to publish them on wgzimmer.ch and in the wgzimmer.ch app, including in the search, on the map and in the memory game.
- You confirm that you hold the necessary rights and do not infringe the rights of others.
- Third parties may not take over ads or parts of wgzimmer.ch without our consent, including by automated means. You authorise us to take action against such a takeover of your ads.
- The design, texts, figures and logo of wgzimmer.ch belong to us.
9. Liability
- You are responsible for your ads and messages. If you breach these terms or the law and third parties hold us liable for this reason, you indemnify us against these claims and the reasonable costs of defending them.
- To the extent permitted by law, we are not liable for the content of ads and messages, for contracts and dealings between users, for damage caused by fraud of third parties or for interruptions or loss of data. We are liable for intent and gross negligence in accordance with the law.
10. Data protection
How we process personal data is described in our privacy policy.
11. Changes
We may change these terms. We publish the new version here with its date; from then on it applies to new ads, logins and messages. We inform account holders of significant changes by e-mail.
12. Applicable law, jurisdiction and language
- Swiss law applies.
- The place of jurisdiction is Basel. For consumers, the mandatory places of jurisdiction provided by law remain reserved, for example their place of residence.
- If a provision of these terms is invalid, the others remain valid.
- Only the German version is binding. Translations are for information only.
